Apple is involved in yet another case against them. A consumer has sued Apple for their Apple Watch batteries swelling and thereby cracking or separating the screen in the tightly packed device.

After Plaintiff Gina Priano-Keyser went to court due to his Apple Watch failing, the Cupertino company started arguing that the consumer failed to state viable claims under the New Jersey Consumer Fraud Act and is now asking U.S. District Court for the District of New Jersey to toss the case in a new filing from the 17th of May.

Ms Priano-Keyser bought a third generation Apple Watch in October 2017 and is claiming that the battery had swollen up and cracked the screen until the screen finally fell off the device.  She claims that after booking an appointment with an Apple Genius Bar, she was refused her warranty and that she would be forced to pay for a replacement if she wanted one. She now seeks damages “in an amount to be proven at trial for herself and all others similarly situated.”

Ms Priano-Keyser is also claiming that not only her Apple Watch model is suspectable to this defect but all Apple Watch models produced to date.

The U.S. District Court of New Jersey is yet to come forward with an official decision regarding the case.
